What A Property Owner Needs To Know About Evictions

In 2019, Andrew Cuomo oversaw the passage of legislation making it much more burdensome on landlords trying to evict tenants for non-payment or any other reason.

The new legislation requires “formal process service” on all predicate notices (such as the 14-day demand for payment).

The new legislation also provides tenants with one “free” adjournment in Court, which usually means the process can take several months (often times four months or more from start to finish).

In Erie County, all residential landlord tenant matters are now diverted to Buffalo City Court (instead of the local Justice Courts such as Cheektowaga Town Court or Amherst Town Court).

At Buffalo City Court, tenants are provided with a “free” lawyer who is very skilled in nit-picking eviction paperwork.

The result for landlords is that the eviction process is very difficult to navigate without an attorney to help.
